Located in Northeastern Pennsylvania, southeast Wyoming county, falls township, pa 18615. Approximately 20-30 minutes away from the core-of-the-core Marcellus shale gas drilling sweet spots in northwest Wyoming county, Bradford and Susquehanna counties. Tunkhannock, the Wyoming county seat, is 10 minutes away along route 92 north. Scranton, in Lackawanna county, and Wilkes-barre in Luzerne county, are 30 minutes away. The property is bounded by the Reading Blue Mountain and Northern railroad on the west and by State Route 2013 (aka Hoppy Road) on the east and farms on the north and south. A very small part of the property, in the extreme southeast, is located in Lackawanna county.

Structures

The 17.764 acre parcel contains four commercial/industrial buildings totaling roughly 19,990 square feet of floor space not including any second floor office or storage space. All buildings have high ceilings (except for offices, which are 8) and concrete or asphalt floors as well as large overhead garage doors. The property has approximately 1,375 /- feet of road frontage on SR 2013.

Water availability:

Abundant groundwater is available on the property. Ground water withdrawal for irrigation and other purposes or direct withdrawal from the Susquehanna River (the River) is subject to rules and regulations of the Susquehanna River Basin Commission (SRBC). A surface water withdrawal from a surface source, such as the River, in excess of 100,000 gallons per day over a 30-day period requires the filing of a surface water withdrawal application. In the river basin, all new (post-1970) consumptive uses that are greater than 20,000 gallons per day for any consecutive 30-day period are subject to the SRBCs consumptive use make-up regulation. Agriculture is currently exempt from the SRBCs consumptive use restrictions. The landowner has a non-exclusive right to withdraw and use unlimited water for on-site household and domestic usage, but must register all withdrawals exceeding 10,000 gpd under the Pennsylvania water resources planning act, and/or secure project review for withdrawals of 100,000 gpd or consumptive use exceeding 20,000 gpd, pursuant to the Susquehanna river basin commission. SRBC regulations are subject to change and the above should not be relied upon in making any decisions on water availability. Please contact the Wyoming county conservation district or the SRBC directly for information on when a permit is required for water withdrawal via well or directly from the river.

Railroad

The property is bounded on the west by the Reading Blue Mountain and Northern railroad (BMNR) for approximately 1,115 /- feet. The railroad makes 1-2 trips north and south each day with freight. There previously was rail siding. The railroad may be willing to add rail siding or other rail implements for a new owner as it is interested in having the site operational again as evidenced by correspondence from Wayne Michael, president of the BMNR, who said, that BMNR is very familiar with the site and has looked upon it for a long time as a potential facility for the Marcellus shale business. He indicated there would be no need to install siding until someone actually purchased the site, in which case it would be their responsibility to bear that cost. A buyer would need to confirm with the railroad use of the railroad for shipping and receiving and should not rely on any seller information concerning the railroad. "

Negotiation and Purchase and Sale Agreement. Dispute Resolution/Arbitration Policy. Each party involved in the arbitration shall pay its own costs and attorneys fees, the fee and expenses of its own arbitrator, and one-half of the fee and expenses of the third arbitrator. All other expenses of the arbitration shall be equally divided between the said parties. Any action filed in order to enforce this Agreement, including an arbitration award will be filed solely in the courts located in Wyoming or Luzerne counties of Pennsylvania in the Sellers sole and absolute discretion.

The parties to any such arbitration agree, and the appointed arbitrators shall agree, as part of acceptance of nomination, to keep confidential and not disclose to persons not connected with the arbitration the details of the arbitration proceeding and all information received by them as may be required by process of law.
