The 21 lots of Phase II are improved only with a gravel road and will be sold as a single unit.
The 31 lots of Phase III, with 324 feet of frontage on Hanson Road, will be sold as a single unit. Phase III could be surveyed and reconfigured differently, subject to Planning and Zoning approval.
2% Broker Participation Any licensed Broker who produces a bidder who buys and closes and abides by all the terms of the Broker Participation Agreement will receive a 2% commission.
The buyer of the 21 lots of Phase II will enter an agreement with McCracken Fiscal Court regarding the development of the unfinished portion of Phase II with a letter of credit or bond for its funding. Also the Phase II buyer will secure the election of Trustees for the Homeowners Association involving individual home owners in Phase I and II and the buyers of the unfinished lots of Phase II, mainly for the care of the common area, which has been about $1,000 a year. These terms are according to Judgment and Order of Sale, Civil Action No. 11-C1-770.
