Legal Description: The following described real estate, situated on the waters of Bear Creek, Sheridan District, Lincoln County, West Virginia, and bounded and described as follows:

All that certain tract or parcel of real estate, lying and being in the County and District aforesaid, containing Forty (40) acres, more or less, and being on the right hand side of the secondary State Highway, which highway runs up a small hollow from the Bear Creek Road leading up to the M. E. Estep farm.

The said parties of the first part further grant and covey unto the parties of the second part and the survivor thereof, the right to the use of free gas on the premises herein conveyed as long as gas is produced on the lease now over said real estate, but the mineral rights are otherwise excepted and reserved in this conveyance.

LESS AND EXCEPT THE FOLLOWING TRACTS OR PARCELS OF LAND:

Six (6) acres as conveyed in that certain Deed bearing the date of July 21, 1978, to Mark A. Dillon and Rhonda L. Dillon, as joint tenants with the right of survivorship, of record in the Office of the Clerk of the County Commission of Lincoln County, in Deed Book 207 at Page 201, on August 7, 1978.

Five (5) acres, more or less, as conveyed in that certain Deed bearing the date of November 24, 1989, to Jirl Brunty, of record in the Office of the Clerk of the County Commission of Lincoln County, in Deed Book 248 at Page 571, on November 30, 1989.

One (1) acre, more or less, as conveyed in that certain Deed bearing the date of August 16, 2001, to Mark A. Dillon and Victoria A. Dillon, as joint tenants with the right of survivorship, of record in the Office of the Clerk of the County Commission of Lincoln County, in Deed Book 269 at Page 793, on August 17, 2001.
