Auctioneer’s responsibility is only to conduct the auction, and auctioneer is not responsible for delivery or removal of merchandise, accidents, or theft. The Tollesboro Lions Club will also accept donations of personal property and/or equipment/machinery from individuals or businesses, and will provide a record and receipt of your donation for income tax purposes!!!

COMMISSION RATES:
The Tollesboro Lions Club has provided the advertising and the grounds for which this auction is conducted, and shall be entitled to collect a commission on all merchandise offered for sale! The commission rates shall be as follows:
The commission rate for PERSONAL PROPERTY (items not considered as Farm Equipment or Machinery --- the Auctioneer shall have full authority to determine whether the property sold shall be considered Personal Property or Farm Equipment and thus which rate will prevail) shall be 25 percent of the final selling price, however, with regards to special collection, an estate, or high value personal property such as antiques --- or even real estate, the auctioneer has some latitude to offer a reduced commission rate --- contact auctioneer directly if you have concerns relative to consigning property of substantial value. With regards to vehicles, the commission rate shall be 15 percent of the final selling price if sold for less than $1000, and 10 percent if sold or more than $1000. With regards to automobiles, the Tollesboro Lions Club advises that the buyer and seller meet at the county court house and transfer titles, as well as providing proof of insurance, prior to permitting sold vehicles to be removed from the grounds --- an exception should be made for removal of automobiles from the grounds by licensed dealers. The Tollesboro Lions Club assumes no responsibility relative to vehicles removed from premises prior to transfer. As the Tollesboro Lions Club is not a permanent auction site, it shall be permissible to consign guns for auction sale; however the purchaser will be required to be a Kentucky resident, 18 years of age, not a convicted felon, and of sound mind and shall be required to sign the receipt acknowledging same and which will include the serial number of the gun. The Tollesboro Lions Club reserves the right to refuse to sell any items, in particular those considered dangerous, illegal or of questionable legality, not politically correct, of environmentally questionable character (this includes tires, on or off rim, chemicals, barrels, etc.), etc.
The commission rate for farm equipment/machinery shall be based upon the final sale price per item, and shall be as follows:
10 percent on all items bringing up to and including $1000 --- however no commission rate/fee shall be less than $10 / item; 5 percent on all items bringing $1001 or more --- however the minimum commission rate for such items shall not be less than $100 / item. However, the maximum commission charged per item shall be $350.
This auction is not advertised absolute, thus is a sale with reserve. In all instances, it shall be the seller’s/consignor’s responsibility to reject any sales by being the last bidder on an item that fails to meet said seller’s/consignor’s reserve. In the event that an item fails to meet the consignor’s/seller’s reserve, a commission shall still be due and payable, as a “reject fee”. The reject fee shall be the sum of 3 percent of the final bid, however not less than $10, with a maximum reject fee of $125.
ANYONE CONSIGNING AN ITEM OR ITEMS TO THE AUCTION SHALL BE REQUIRED TO SIGN AN AUCTION CONTRACT!!! NO EXCEPTIONS! This includes consignors who intend to donate the proceeds of merchandise sold. Included in the auction contract is a statement indicating whether any mortgages or liens exist on the merchandise, in which case, the “net proceeds” check for such items will be made jointly to the consignor and the holder of the mortgage/lien. ALSO, IF YOU CALL IN TO INCLUDE AN ITEM TO ADVERTISE, IT MUST BE BROUGHT TO THE TOLLESBORO LIONS CLUB TO BE OFFERED AT AUCTION! Do not advertise an item to sell if you do not intend to deliver it!!!
TERMS OF PURCHASE: All merchandise sold is purchased “AS IS – WHERE IS” without warranty expressed or implied, including fitness/merchantability/marketability for an implied/specific/desired use. Any warranties are between the purchaser and seller; no liability is retained by the auctioneer or the Tollesboro Lions Club relative to warranties or condition. All purchases must be paid for in full immediately following the sale, by cash or good check made payable to the Tollesboro Lions Club (credit cards can not be accepted for payment; sorry for an inconvenience). Sales tax will be required when applicable. Buyer’s Numbers/Registration is required. A $1 fee will be charged for all buyer’s numbers and an additional $1 fee per item purchased will be charged as a processing fee (remember, these proceeds benefit the Tollesboro Lions Club, a non-profit charitable organization. Be Supportive, Not Negative!). NO BUYER’S PREMIUM! Merchandise must be removed from the grounds within one week of sale date. Loading Equipment will be available on-site the day of sale, not necessarily any other date. Tollesboro Lions Club not responsible for items left on premises. Announcements made day of sale take precedence over printed matter.
OTHER TERMS OF SALE: Commission will be charged on all items sold or offered for sale at the rates posted above. Sales Proceeds will be distributed within 15 business days of the auction. The “Buyer’s Registration fee” and the “per item” processing fee are not considered as part of the consideration paid for purchases, and is to be retained by the Tollesboro Lions Club as a charitable donation (unlike a buyer’s premium, these fees are not subject to tax). Absentee bids may conditionally be permitted --- without guarantee! However payment in full is required date of sale, and any items so purchased will be subject to an additional “convenience fee”(not subject to tax and not a part of the consideration paid for the merchandise purchased) based upon finals sales price will be assessed --- contact auctioneer for concerns regarding absentee bids. The auctioneer and the Tollesboro Lions Club/Membership thereof, take NO RESPONSIBILITY whatsoever relative to reserve bids; reserves, while a seller’s/ consignor’s right, are to be the sole and exclusive responsibility of the respective owner/seller/consignor.

The auction will be conducted at the Tollesboro Lions Club Fairgrounds located on the Lions Club Lane (also known as Fairgrounds Lane or Grainery Lane), Tollesboro, Lewis Co., Kentucky. Tollesboro is located nearly equi-distant from Maysville (county seat of Mason Co., KY, approximately 10 miles west), Flemingsburg (county seat of Fleming Co., KY, approximately 15 miles south), and Vanceburg (the county seat, approximately 16 miles east), as well as being approximately 10 miles south of Concord and the Ohio River (the Ohio River forms the northern boundary of Lewis Co., KY). The Fairgrounds Road is located on the north side of KY 9, the "AA" Hwy. and is a connector road to KY 10, just west of the intersection of KY 9 and KY 57.
