1. The property conveyed will be subject to any and all utility and drainage easements.
2. The lot conveyed will be restricted to single family residential use only.
3. Any residence erected upon the lot conveyed shall have a minimum of 1250 square feet of finished living space above grade, excluding decks, porches, garages, driveways, and basements.
4. Mobil homes, double wide sectionals, or modular homes will not be permitted to be placed on the lot conveyed.
5. No dishes or satellite receivers shall be located in the front yards or on the front of any residence.
6. A private garage maybe built separately or attached to and made a part of Residence, but shall be of the same exterior materials and conform in construction to the residence. and shall be maintained in a neat and clean manner.
7. No dog kennels, cat kennels or dog lots containing more than four animals.
8. Junked, inoperative, or unlicensed vehicles shall not be stored or kept on any Tract, either temporarily or permanently unless they are fully enclosed in a building; this restriction shall not, however, include camper trailers or boats.
9. No dumpsters, refuge containers, or recycling bins shall be maintained on the premIses.
10. Foundations of all residences shall be of brick or stone construction; cinder block or concrete block as visible foundation shall be unacceptable.
11. All stumps, brush, and debris created when clearing the area for the dwelling must be burned, buried, or removed from the property conveyed.
12. No playground equipment to be located in the front yard of the property conveyed.
13. Commercial use and nuisance: No store, tavern or other public, commercial, industrial or professional business as at any time be maintained or established or permitted upon any tract, except for home offices or small businesses run out of the home with off-site sales and lor transactions. Commercial swine, dairy, and poultry livestock production facilities will not be allowed. This clause shall not be interpreted, however, to prevent the growing of hay, straw, com, small grains, cotton, legumes, or other types of field crops upon the property or the maintenance of small numbers of pasturing livestock for pleasure or agricultural purposes as permitted by county zoning.
14. All structures shall be completed on the exterior, and all grading, landscaping and seeding, shall be complete with one (l) year from commencement of construction.
15. Barbed wire or any fencing employing metal or plastic "T" stakes will not be allowed.
16. Motorized vehicles shall be prohibited for use on 30' right of way trail except for maintance purpose.
17. Lots shall not be subdivided.
18. Developer reserves the right in its sole discretion to amend any Protective Restrictions herein, until such time as eighty percent (80%) of the Tracts have been sold; the Developer reserve the right to amend the protective
Restriction with concurrence of a two-thirds (2/3) ofthe Tract owners (declaring is also considered owner) within the Subdivision.
19. Duration: That at that time after (10) years have elapsed from the date of execution of this Declaration, a two-thirds (2/3) majority of the then property owners may change or terminate, in whole or in part, the 30' right of way trail by signing and recording in a lawful manner in the aforesaid Clerk's office, and instrument to such effect; provided further that in the event any Protective Restriction set forth herein is invalidated by any court, a two-thirds (2/3) majority of the then property owners at any time thereafter may, by signing and recording an appropriate instrument, replace such Restrictions governing the subject matter of the invalidated Protective Restrictions.
